On December 19, 2024, an agreement was concluded between the Mazovian Voivode and the city of Warsaw on entrusting the city of Warsaw with certain matters within the scope of the Mazovian Voivode’s jurisdiction, carried out by the Mazovian Voivodeship Historic Preservation Officer.
The agreement was announced in the Official Journal of the Mazowieckie Voivodeship under item 13064 and came into effect on March 1, 2025. The legal basis for the agreement is Article 96(2) of the Law on the Protection of Monuments.
Under the agreement, the City of Warsaw assumed responsibility for the protection of immovable monuments, including parks and gardens, located on the territory of Warsaw, with the exception of several precisely defined categories of monuments, such as monuments owned by government administration bodies or monuments listed by UNESCO. The transfer of these powers to the capital is intended to streamline the decision-making process and better protect Warsaw’s monuments.
The City of Warsaw has taken over a wide range of activities related to the protection of historical monuments, including agreeing on conservation work programs, issuing permits for conservation work and conducting archaeological research. In addition, the City of Warsaw will be responsible for issuing decisions on changes in the use of historic monuments, as well as issuing opinions on construction investments in the context of monument protection and possible conservation work.
At the same time, the agreement stipulates that the City of Warsaw will have access to relevant archival and administrative materials in the field of historic preservation, which is expected to facilitate the proper implementation of tasks. All administrative decisions related to the entrusted tasks will be forwarded to the Mazovian Voivodeship Conservator of Monuments, which will ensure control and coordination of activities.
The agreement is concluded for an indefinite period of time with the possibility of termination at 6 months’ notice.
