SRC Law Firm represented a Client, a residential developer, before the Provincial Administrative Court.
The case concerned a decision by the President of the City of Warsaw, unfavorable to the Client, to refuse to issue zoning conditions for an investment involving the superstructure of additional floors in a residential building in the very center of Warsaw.
As part of the administrative proceedings, the authorities of both instances refused to issue a decision on zoning conditions, citing non-statutory reasons, based on “urban order”, with additional reference to the features of the surrounding buildings, outdated for over a decade.
As a result of a complaint filed by SRC Law Firm, the Provincial Administrative Court ruled in favor of our Client, overturning the above refusal decisions.
