SRC Law Firm represented one of the leaders in the fertilizer and chemical industry in Europe before the Supreme Administrative Court in seven cases concerning property tax overpayment for the years 2013-2018.
The cases concerned the unjustified taxation of the entrepreneur’s land at the property tax rate appropriate for land on which business activity is carried out, even though this activity was not in fact carried out on it.
At an earlier stage of the proceedings, the Regional Administrative Court overturned the decisions of the tax authorities, as a result of which the tax authorities filed cassation complaints.
The Supreme Administrative Court recognized the arguments of SRC contained in its responses to the cassation complaints and overturned the unfavorable decisions of the tax authorities, which allowed the Client to recover almost two million zlotys of overpaid tax.
